- Serve as the primary day-to-day commercial contracting resource supporting Sales from receipt of a proposed agreement through execution, with accountability for process ownership, coordination, and momentum.
- Coordinate cross-functional reviews; consolidate input; and maintain redlines, open-item and risk lists, negotiation matrices, decisions, approvals, version control, and a clear audit trail.
- Identify material commercial exposures involving scope, schedule, payment, performance obligations, liquidated damages, warranties, bonding, insurance, changes, and closeout.
- Develop commercial positions and negotiation priorities, participate in customer contract discussions as appropriate, and escalate legal interpretations and approvals to Legal.
- Confirm that proposal assumptions, pricing qualifications, supplier commitments, and customer requirements are aligned before execution.
- Lead the commercial handoff from pursuit to execution, ensuring commitments, qualifications, unresolved items, and approval conditions are clearly transferred to the project team.
- Prepare concise project commercial summaries and obligation matrices covering critical notices, milestones, payment terms, schedule requirements, changes, warranties, and closeout deliverables.
- Facilitate project commercial kickoff sessions and establish risk-based tracking for material obligations, decisions, correspondence, and commercial actions.
- Maintain visibility of significant commercial risks and opportunities and escalate items requiring leadership or Legal engagement.
- Partner with Project Managers and Project Controls to identify scope changes, customer directives, delays, differing conditions, supplier impacts, and other potential entitlement events.
- Support timely notices, reservations of rights, change-order substantiation, commercial correspondence, and tracking of approved, pending, and potential changes.
- Connect commercial events with cost, schedule, forecast, billing, and cash-flow impacts; highlight aging or material exposure through monthly project reviews.
- Support alignment of major subcontract and equipment-purchase obligations with applicable prime-contract requirements, including material flow-down gaps and supplier changes.
- Assist with claims documentation, event chronologies, and commercial positions, coordinating with Legal on disputes, interpretation, and other material legal matters.
- Promote appropriate documentation and authorization before material out-of-scope work proceeds.
- Coordinate commercial closeout requirements, including final changes, reconciliation, releases, warranties, lien waivers, and outstanding deliverables.
- Capture recurring issues and lessons learned and feed them back to Sales, Estimating, Development, Operations, Supply Chain, and Legal.
- Establish and continuously improve commercial review and execution processes, workflows, templates, tools, dashboards, and training, including evaluation and implementation of appropriate contract-management software.
- Apply risk-based tiering and scalable workflows so intensive support is focused on material pursuits and high-risk projects while routine activity follows standard tools and controls.
- Bachelor's degree in Construction Management, Legal, Engineering, Business, Finance, or a related discipline, or equivalent relevant experience.
- Five (5)+ years of experience in commercial construction, preconstruction, project management, project controls, estimating, commercial operations, or a related field.
- Experience supporting electrical infrastructure, energy, EPC, design-build, or other complex capital projects.
- Working knowledge of proposal qualifications, commercial terms, change management, notices, payment provisions, schedule impacts, warranties, bonding, insurance, and project closeout.
- Ability to translate complex commercial requirements into clear decisions and actions for cross-functional teams.
- Strong commercial judgment, communication, facilitation, organization, and negotiation skills, with the ability to influence across functions and manage multiple priorities.
- Experience with power, electrical construction, BESS, distributed generation, microgrids, EV infrastructure, switchgear, or major equipment procurement.
- Familiarity with AIA, ConsensusDocs, EPC/design-build agreements, and customized owner or general-contractor forms.
- Experience with ERP, project-management, document-control, or commercial workflow systems; CCM, PMP, CPCM/NCMA, or another relevant certification is beneficial.
Skills Required
