Summary
The Aspen Group's Legal Department is seeking a Director of Marketing and Intellectual Property Compliance to join our team. This is a high-impact, cross-functional role for a detail-oriented compliance professional who thrives on building structure, partnering across teams, and maturing functions from the ground up. Reporting into the Legal Department, this individual will serve as the first line of review for marketing compliance and will own the organization’s intellectual property compliance program. Essential Functions, Job Duties & Responsibilities:
Marketing Compliance
Review marketing and advertising materials for accuracy, regulatory compliance, and adherence to applicable legal and industry standards, escalating to legal counsel as appropriate.
Partner closely with the Marketing and Commercial teams to provide ongoing education, practical guidance, and best practices on marketing compliance requirements.
Develop and deliver regular training and communications to keep cross-functional partners informed of evolving compliance expectations.
Function Building & Operations
Lead the maturation of the marketing compliance function by designing and implementing scalable processes, workflows, and controls that bring consistency and order to how materials are reviewed and approved.
Own the development and ongoing refinement of a ticketing and intake system to manage, track, and prioritize compliance review requests.
Establish meaningful metrics and KPIs to measure function performance and support reporting to Legal leadership.
Intellectual Property Compliance
Manage the organization’s trademark portfolio, including all marks used across The Aspen Group’s brands and affiliated entities.
Ensure appropriate and timely registration and prosecution of marks in coordination with outside counsel as needed.
Manage trademark enforcement: monitor for infringement (including watch-service and alerts), triage and classify alerts, run the cease-and-desist and opposition/cancellation. workflow in coordination with counsel, and escalate enforcement go/no-go decisions to Legal
Support broader IP compliance efforts across the department, leveraging the natural synergies between marketing and intellectual property.
Requirements/Qualifications:
A Bachelor's degree (or equivalent professional experience.)
An ABA-approved paralegal program completion or a paralegal certificate is a plus.
J.D. or Master’s degrees are not required, but advanced-degree candidates are encouraged to apply.
7+ years of experience in marketing compliance, regulatory affairs, intellectual property, or a related field, ideally in a multi-brand, multi-location, or healthcare/consumer services environment.
Strong working knowledge of advertising standards, marketing regulations, and trademark law; a J.D. is not required but candidates with legal training or paralegal backgrounds are welcome.
Familiarity with healthcare advertising regulations and guidelines — including FTC rules, state dental board advertising requirements, state unfair and deceptive practices laws, patient financing advertising requirements, and CMS/state-specific restrictions — is strongly preferred; candidates who understand the compliance stakes in a regulated healthcare environment will ramp quickly and add immediate value.
Demonstrated ability to build and scale compliance programs, including process design, system implementation, and cross-functional change management.
Experience managing trademark portfolios and working with the USPTO or outside IP counsel preferred.
Exceptional attention to detail, strong written communication skills, and a collaborative, service-oriented approach.
Comfortable operating independently in a fast-paced environment while knowing when to escalate.
Base Pay Range: $140,000-150,000, annually (Actual pay may vary based on experience, performance, and qualifications.)
This position offers a hybrid or remote work arrangement based on your location. Candidates residing within 35 miles of our Chicago, IL (Fulton Market) office or within 45 miles of our East Syracuse, NY office are expected to work on-site. Candidates living outside of these areas are eligible for full remote work.
