This position will focus on Association and Plan compliance with, and interpretation of the Brand Regulations and license agreements. In addition, this position will assist with enforcing the proprietary rights owned by the Association by investigating, negotiating and resolving disputes. Further, this position will provide support for the clearance of potential trademarks and the prosecution of the Association’s international and domestic trademark portfolios. Finally, this position may assist the Brand legal team with special projects as needed.

  • Assist Brand Counsel in reviewing Plan and Association materials for proper Brand usage in accordance with the Brand Regulations, License Agreements and sound trademark practices, including conducting the annual Brand Use Review of Plan materials, supporting operation of the Brand Use Portal, and working directly with Plans in identifying and resolving compliance matters.
  • Assist with misuse of the Brands and enforcement of the Brand Regulations including: (1) investigating potential Brand misuse matters, preparing draft correspondence and settlement agreements, and communicating with Plans and third parties concerning misuse matters; and (2) assisting with domain portfolio and related online enforcement matters.
  • Assist in domestic and international trademark prosecution and enforcement work, including: (1) providing back-up support in the management of the trademark prosecution docket and domestic infringement matters; and (2) conducting trademark scans for proposed new marks developed by the Plans and the Association and for third party marks to support enforcement activities.
  • Assist in additional Brand-related projects and responsibilities as assigned.

  • A minimum of five years’ experience as a trademark, corporate or litigation paralegal, or equivalent work experience
  • Experience conducting due diligence in a law firm or corporate environment Experience using Microsoft Word, Excel, PowerPoint and Access including data entry and retrieval and online searches and investigations (e.g. Nexus, D&B)
