Job Description

The Senior Bankruptcy Specialist will play a key role in managing bankruptcy cases, assisting with legal proceedings, and ensuring compliance with all applicable bankruptcy laws and regulations. This position requires a Paralegal background and experience in bankruptcy law to handle complex cases, collaborate with internal teams and external legal partners, and support the company’s interests in bankruptcy proceedings. The Senior Bankruptcy Specialist will work closely with the legal team to facilitate timely, accurate, and compliant filings, and will ensure all necessary documentation and records are maintained throughout the bankruptcy process.

Position Highlights:
 

  • Identified candidate must complete and clear a background check and drug test successfully prior to start
  • Only US Citizens are eligible for this specific contract, hence for this position, Iron Mountain will consider only US Citizens.
  • Benefits start from first day, 2 weeks of PTO
  • Identified Candidate will need to work Eastern Time
Key Responsibilities:

Bankruptcy Case Management:

  • Oversee and manage the bankruptcy claims process for individuals and businesses, including filing proofs of claim, monitoring case progress, and ensuring all deadlines are met.
     

  • Prepare and review bankruptcy petitions, schedules, and other related documents in accordance with applicable bankruptcy laws.
     

  • Coordinate with external bankruptcy attorneys to ensure all aspects of the case are handled appropriately.
     

  • Conduct thorough research of bankruptcy cases to identify potential recovery options and the best course of action for the company.
     

  • Serve as the point of contact between the company, its creditors, and legal teams in bankruptcy matters.
     

Legal & Documentation Support:

  • Draft and file all necessary legal documents related to bankruptcy cases, including motions, objections, notices, and response documents.
     

  • Maintain accurate and up-to-date records for all bankruptcy proceedings and related documentation, ensuring compliance with legal requirements.
     

  • Provide paralegal support in preparing bankruptcy-related pleadings and correspondence.
     

  • Assist with preparing and reviewing settlement agreements, plans of reorganization, and other related legal documents.
     

Dispute Resolution & Negotiation:

  • Assist with negotiating settlements and payment arrangements with debtors, creditors, and attorneys in bankruptcy cases.
     

  • Work closely with the legal team to resolve disputes and manage ongoing bankruptcy negotiations.
     

  • Provide analysis of debtor repayment capabilities and assess potential recovery options.
     

Compliance & Legal Support:

  • Ensure compliance with federal, state, and local bankruptcy laws and regulations, including the Bankruptcy Code and relevant case law.
     

  • Stay up-to-date on changes in bankruptcy laws and regulations to ensure that company practices remain compliant.
     

  • Assist with any litigation related to bankruptcy cases, including preparing evidence, legal briefs, and motions.
     

Reporting & Communication:

  • Prepare and maintain detailed reports on bankruptcy cases, including status updates and financial recovery projections.
     

  • Communicate effectively with internal departments, external legal counsel, and third parties to provide updates on bankruptcy case progress.
     

  • Liaise with finance and collections teams to ensure that all necessary actions are taken on outstanding debt and that legal compliance is maintained.
     


Training & Mentorship:

  • Provide guidance and mentorship to junior team members or paralegals, sharing expertise on bankruptcy procedures and best practices.
     

  • Assist in training staff on bankruptcy procedures, laws, and internal protocols.
     

Qualifications & Skills:

Education & Experience:

  • Paralegal certification or a degree in Paralegal Studies, Law, or a related field.
     

  • Minimum 5-7 years of experience as a Paralegal with a focus on bankruptcy law and proceedings.
     

  • Experience working within a legal department or with external legal counsel in handling bankruptcy cases.
     

Technical & Industry Knowledge:

  • In-depth knowledge of bankruptcy laws, including Chapters 7, 11, and 13 of the U.S. Bankruptcy Code.
     

  • Strong understanding of bankruptcy court procedures, filing requirements, and deadlines.
     

  • Familiarity with bankruptcy software and tools (e.g., CM/ECF, Pacer, etc.).
     

  • Proficiency in legal research and document drafting related to bankruptcy proceedings.
     

Soft Skills:

  • Strong analytical skills with the ability to assess legal and financial documents for accuracy.
     

  • Excellent communication skills, both written and verbal.
     

  • Attention to detail and the ability to manage multiple complex cases simultaneously.
     

  • Strong problem-solving skills with the ability to handle sensitive legal and financial matters.
     

Preferred Qualifications:

  • Experience in both creditor and debtor-side bankruptcy proceedings.
     

  • Knowledge of Chapter 11 reorganization processes.
     

  • Bilingual abilities (if applicable).
