Key Responsibilities:
- Lead the Contract Management responsibilities for the Project, reporting functionally to the ITR Contract Management Leader (Asia), and operationally to the Project Director/Project Manager.
- Lead the Contract Management responsibilities in the assigned Project, which includes but not limited to managing, addressing, discussing, providing resolutions on all Contracts and/or Consortium Agreement-related matters, externally involving the Customer and/or Customer's Engineers; the Turnkey Project Partner and its affiliates/subsidiaries (if required); internally involving GEV's cross function and stakeholders e.g. EHS, Quality, Engineering, Sourcing, Site Management and/or Construction & Commissioning functions/teams.
- Complete ownership of ALL Contracts-related GEV tools and/or applications – where such tools and/or applications shall be updated consistently and in detailed manner to reflect the latest developments, status, progress and updates as required.
- Complete ownership of ALL Contracts-related documentations such as but may not be limited to Project Execution Plan, Project Execution Strategies, Risk Scorecards – where such documentations shall be updated consistently and in detailed manner to reflect the latest developments, status, progress and updates as required
- Creation and maintaining of a detailed, systematic and thorough commercial and contractual incoming and outgoing correspondences register – which shall include specific details such as but not limited to receipt/issuance dates, brief description of the issue/matter raised in the correspondence, reference no’s, person-in-charge, status of correspondences, remarks (if required). This shall include ALL correspondences with Customers, Customer affiliates/subsidiaries, Customer’s Engineers, Turnkey Project Partners, Turnkey Project Partner’s affiliates/subsidiaries (if required), GEV’s Supplier/s and/or GEV’s Subcontractors (if required)
- Complete ownership in ensuring timely issuance of letters from GEV to external Parties (Customers, Customer’s affiliates/subsidiaries, Customer’s Engineers, Turnkey Project Partners, Turnkey Project Partner’s affiliates/subsidiaries (if required), GEV’s Supplier/s and/or GEV’s Subcontractors (if required)\Complete ownership in ensuring timely replies to letters received from external Parties (Customers, Customer’s affiliates/subsidiaries, Customer’s Engineers, Turnkey Project Partners, Turnkey Project Partner’s affiliates/subsidiaries (if required), GEV’s Supplier/s and/or GEV’s Subcontractors (if required)
- For all commercial and/or contractual correspondences, where the issuance of letters from GEV to external Parties and replies to letters issued to GEV by external Parties, the Project Contracts Manager shall lead the drafting of all such correspondences which shall include but not limited to identifying the relevant contractual clauses/articles as per the Contracts and/or Consortium Agreements, identifying the GEV internal stake-holder/s whom would be required to gather and consolidate relevant information/s and/or details, discussing the final draft and finalizing the actual letters/Minutes of Meetings/memorandums etc. and ensure the final issuance of such correspondences, all of this done within the required time-frame required within the Contracts and/or Consortium Agreement.
- Lead and manage Risk and Opportunity identification, discussion and mitigation actions (throughout the entire Project life cycle) which shall include but not limited to risk mitigation actions follow-up and support and pursuing Change Orders with external Parties.
- Shall attend and participate in all required (mandatory) and/or relevant (will be advised/instructed during the course of Project execution) meetings with Customers, Customer’s affiliates/subsidiaries, Customer’s Engineers, Turnkey Project Partners, Turnkey Project Partner’s affiliates/subsidiaries (if required), GEV’s Supplier/s and/or GEV’s Subcontractors (if required) during the entire Project life cycle and/or other meetings as required.
- Shall attend and participate in all relevant GEV-internal meetings at Project, Site and/or functional level including but not limited to Weekly Project Meetings, Weekly Site Meetings (as and when required), Monthly Customer Meetings, Weekly Turnkey Project Partner Meetings, Daily Management Meetings, Global/Regional Project Review Meetings, Risk and Opportunity Meeting, Weekly/Monthly Contract Management Team Meeting and any other meetings as required.
- Responsible for matters related to Insurance matters which shall include but not limited to all correspondences, communications, notifications and/or claim submissions with the Insurer/s, and where required or necessary, to seek advice and support from the Insurance specialist.
- Fully responsible for all contractual, commercial and legal aspects of the Project including but not limited to commercial considerations in GEV’s internal and external supply contracts. The Project Contracts Manager will also support GEV’s Sourcing function with the review and recommendation/suggestions and directions (where necessary) in the review, discussions and finalization of the Project Related Purchasing Conditions document (PRPC).
- Provide Contract-related guidance and support to the Project Director/Project Manager (specifically) and to the Project/Site Team (generally) on incoming and outgoing claims. The PCM shall lead the Project/Site Team’s efforts to mitigate incoming claims against GEV and/or pursue outgoing claims for GEV including contemporaneously obtaining and maintaining documentation, photos, meeting minutes, schedules, reports, information on/from Customers, Customer’s affiliates/subsidiaries, Customer’s Engineers, Turnkey Project Partners, Turnkey Project Partner’s affiliates/subsidiaries (if required), GEV’s Supplier/s and/or GEV’s Subcontractors (if required) on Project/Site delays, concurrent delays, excusable delays, Change Order entitlements etc.
- Shall prepare a Contract Compliance Checklist identifying all obligations, specific requirements, notices, etc. in a tabular format for easy reference and monitoring. The table shall also identify the dates the respective actions are due and the personnel responsible for the execution of the relevant action. The PCM shall take ownership of these documents and update them monthly after consultation with all responsible stakeholder identified in the Contract Compliance Checklist.
- Identify in the Contract Compliance Checklist required actions and monitor those that are over-due, due within the next month, and subsequent months.
Qualifications/Requirements:
- 10 years’ or more, experience in Contracts Management discipline in an international contracting environment, preferably in the Power/Energy or Oil and Gas industry and in large-scaled and complex Turnkey/EPC and Consortium structured contracts.
- Solid understanding of Contract terms and law principles, relevant technical, financial, cost & project risk management principles.
- Demonstrated knowledge and experience relating to delay analysis techniques and methodologies, calculating and analyzing productivity losses, ability to interpret construction contracts, drawings and specifications.
- Strong presentation and negotiation skills at higher management level.
- Ability to demonstrate good people leadership, influencing and management skills including the ability to work independently and communicate effectively within and across all levels of project functional groups of diverse nationalities.
- Accomplished computer skills particularly in utilizing MS-Windows and Office applications (Excel, Word, PowerPoint), project management software, Primavera P6 and/or other equivalent construction industry related software.
- Ability to handle many complex issues concurrently.
- Excellent written and verbal communication skills in both English and Chinese languages.
- Ability and willingness to travel on business trips both within and outside of Taiwan (when required)
- Mandatory travel and presence at Project Site when required (within Taiwan)
