About the job
The Red Hat Legal team is looking for an IP Attorney to join the Intellectual Property (IP) team in Raleigh, NC. In this role, you will assist with all aspects of IP, including (1) Trademark portfolio strategy and maintenance, e.g., identifying strategic needs in the portfolio, working with brand personnel to help protect Red Hat's IP, and supervising the prosecution of trademark applications; (2) defensive IP dispute resolution, e.g., copyright and trademark assertions; and (3) IP enforcement, e.g., copyright and trademark enforcement. As a key member of the IP team, you should have a combination of trademark counseling, IP litigation, and open source licensing experience, along with a software technology background, an innovative spirit, and passion for defending the open source mission. As an IP Attorney, you will report to Red Hat's Senior Director and Assistant General Counsel for IP and collaborate with and support the IP and IP Litigation teams' associates, which will consist of the principal IP counsel, a patent attorney, a patent agent, and corporate legal specialists. This is a great opportunity to work with a variety of experienced legal professionals, brand and marketing specialists, engineers, and developers in a fast-paced setting.
What you will do

  • Assist with copyright and trademark matters, and IP litigation
  • Contribute to the strategic decisions for Red Hat's IP portfolio
  • Assist with IP indemnity requests as needed
  • Assist with defending other IP disputes, including incoming copyright and trademark assertions
  • Ensure that Red Hat's associates and third parties comply with copyright, trademark, and other IP policies
  • Enforce IP rights when necessary to deter third-party infringement
  • Review and help with contest and sweepstakes legal issues
  • Participate in mergers and acquisitions (M&A) due diligence on trademark, domain name, and copyright assets
  • Contribute to Red Hat's global trademark and domain name strategies to align with Red Hat's marketing practices, budget, revenue sources, emerging markets, and infringement hotspots
  • Advise on publicity rights, comparative advertising and unfair competition, and copyright clearance
  • Contribute to Red Hat's copyright and trademark-related internal sites and educational efforts
  • Educate and reach out to the open source community about important copyright and trademark issues, including writing for open source publications like opensource.com


What you will bring

  • J.D. and admission to practice law in at least one jurisdiction
  • 4+ years of legal and IP experience
  • Technology-based IP experience, including trademark portfolio management
  • Strategic and resourceful approach to resolving IP disputes
  • Innovative spirit and passion for promoting the open source mission
  • Demonstrated technical aptitude with a preferred focus in software
  • Excellent written and verbal communication skills, attention to detail, and analytical skills
  • Ability to work in a team environment and on your own with minimal supervision while maintaining a firm focus on applying IP legal principles to practical business relationships and offerings
  • Excellent interpersonal skills and ability to interact well with associates at all levels
  • Effectively manage the details of highly confidential and critical company projects
  • Creative problem-solving skills with a focus on achieving results that benefit our business while recognizing customer needs
  • Ability to maintain effective working relationships with external vendors
  • Highly organized with attention to detail; ability to take ownership, set and handle multiple priorities, and meet deadlines in a dynamic and fast-paced environment
  • Positive attitude and sense of humor


The following are considered a plus:

  • 2+ years of IP experience with a well-regarded law firm and 2 years of in-house experience with an IT industry company
  • Knowledge of and experience with open source software
  • Information technology industry experience, either legal or technical
  • Demonstrated passion for technology, software, IP, and open source licensing issues
