DaVita is seeking a collaborative and strategic attorney to join the regulatory team within the Justice League of DaVita (JLD) as a Director, Senior Corporate Counsel. Within the JLD, you will be a key member of the Regulatory team, providing legal and regulatory support for DaVita's rapidly evolving digital health platforms, Artificial Intelligence (AI) deployment, and interoperability initiatives.

In this role, you will be the primary legal partner for the development, sales, and oversight of digital health platforms, including Electronic Health Record (EHR) software. You will provide strategic, day-to-day legal support to our Physician & Patient Technology Teams, advise on health information exchange strategies, and provide support on enterprise-wide AI initiatives. Working closely with clinical, IT, and compliance leadership, you will ensure our cutting-edge healthcare technologies are deployed responsibly and in compliance with healthcare regulations.

Key Responsibilities

  • Digital Product & Regulatory Counsel: Serve as the primary legal partner for core physician and patient technologies, including specialized EHR systems, physician-facing portals, and secure clinical messaging tools. Guide the business through the full lifecycle of these products—advising on development, sales, marketing, and ongoing operational oversight—to support our physician and patient technology teams. In doing so, proactively identify and mitigate compliance risks by advising on complex federal and state healthcare laws, including fraud and abuse regulations (e.g., False Claims Act, Anti-Kickback Statute and specifically the EHR Donation Safe Harbor, Stark Law, and Beneficiary Inducement laws).
  • Technology Transactions & Cross-Functional Collaboration: Provide legal support and review for a variety of IT contracts, including interface agreements, end-user license agreements, service orders, statements of work, and technology licenses.
  • AI & Interoperability: Assist with AI and Digital Health Capabilities including interoperability initiatives, gaining exposure to evolving health tech regulatory landscapes. Support in tracking emerging AI regulations across federal (e.g., ONC DSI rules, FDA SaMD guidance), state (e.g., state-specific AI acts, laws, and regulations), and other applicable frameworks (e.g., National Institute of Standards and Technology Artificial Intelligence Risk Management Framework, international standards) evaluating legal and ethical considerations for AI initiatives. Additionally, provide support on health information exchange matters, including Information Blocking rules, ONC health IT certification, TEFCA, and API integrations.
  • Strategic Partnership & JLD Collaboration: Cultivate trusted, proactive relationships with business clients, physician and patient technology leadership, and compliance partners. Serve as an engaged liaison within the JLD by participating in committees and partnering seamlessly across other legal lanes to champion broader Village initiatives and foster a vibrant, team-first culture.

Qualifications & Essential Traits

  • Education & Experience:
    • Juris Doctorate degree with at least one active state bar admission (ability to waive into CO, if needed).
    • Minimum of 5-8+ years of corporate or law firm experience representing the healthcare industry.
    • Experience with health care provider operations and/or health IT, including experience handling technology transactions, highly preferred.
  • Expertise:
    • Substantial knowledge of Medicare/healthcare fraud and abuse laws.
    • Familiarity with software development, artificial intelligence/machine learning, and interoperability governance.
  • Legal & Project Management Skills:
    • Transactional drafting and review skills, including experience supporting IT contracts (e.g., interface agreements, EULAs, service orders, SOWs), highly preferred.
    • Ability to own multiple projects, manage multiple matters, meet deadlines, and adjust priorities appropriately in an evolving, fast-paced environment with shifting time frames.
  • Communication & Business Acumen:
    • Excellent written, verbal, and interpersonal communication skills, with an ability to listen attentively and communicate effectively throughout all levels of the organization.
    • Ability to translate legal jargon and complex legal topics into “regular” speak that clients can readily understand and apply to their business.
  • Strategic Partnership:
    • High degree of maturity and professionalism with a desire to work proactively with clients to identify risks and ensure appropriate mitigation strategies are employed.
    • Demonstrated ability to build relationships, work well with cross-functional groups, and interact positively with senior management and business/operations personnel.

The Salary Range for the role is $115,000.00 - $183,000.00 per year.
