The Commercial Claims & NoticesManager will support a large, complex transportation infrastructure program. This role provides strategic hands-on support in identifying, developing, documenting and pursuing contractual entitlements, while ensuring that required notices are timely, accurate and consistent with the company’s contractual rights and commercial objectives.    

Cubic is seeking an experienced infrastructure or construction claims professional who can independently assess commercial entitlement, investigate project events, preserve contractual rights, develop supporting evidence, collaborate with Project Controls and Finance, and personally draft sophisticated notices and claims. 

This is not primarily contract administration, document control, or tracker-management position. This is a hands-on claims role for a professional who can quickly assume ownership of an established claims and notice governance framework and drive matters from initial event identification through recovery. 

 

Essential Job Duties and Responsibilities 

  • Work directly with project and program teams to identify potential claims and notice events across engineering, design, systems integration, testing, commissioning, construction, operations, third-party interfaces, and owner-directed activities at the earliest opportunity. 

  • Draft contractual notices, supplemental notices, reservation-of-rights correspondence, relief requests, and formal claims. 

  • Develop factual chronologies and investigate project events through correspondence, meeting records, schedules, technical documents, cost records, and interviews. 

  • Perform preliminary contractual entitlement and causation analysis. 

  • Identify evidentiary gaps and drive collection of supporting documentation. 

  • Work with Project Controls on CPM, critical-path, delay, concurrency, disruption, resequencing, mitigation, and acceleration issues. 

  • Work with Finance and project teams to develop defensible claim quantum. 

  • Manage a portfolio of claims at different stages of development and prioritize matters based on value, entitlement, evidence, timing, and recoverability. 

  • Prepare claim strategies, executive summaries, negotiation materials, rebuttals, and responses to owner challenges. 

  • Maintain disciplined governance across claims, notices, relief requests, changes, supervening events, delay events, and related commercial matters. 

  • Provide leadership with clear reporting on claim value, maturity, risk, weaknesses, next actions, and expected recovery. 

Minimum Requirements 

  • 10+ years of progressive experience in construction, infrastructure, transportation, engineering, systems integration, or major-project commercial management. 

  • 5+ years of direct experience in claims, changes, delay, entitlement, or dispute management. 

  • Demonstrated experience personally developing claims from initial event identification through submission and negotiation. 

  • Strong contractual entitlement and notice-analysis capability. 

  • Experience personally drafting complex notices and formal claims. 

  • Working knowledge of CPM scheduling, critical-path analysis, concurrency, delay, disruption, acceleration, and forensic schedule concepts. 

  • Experience developing or supporting claim quantum, including extended-duration costs, labor, subcontractor impacts, rework, escalation, productivity, and other incremental costs. 

  • Strong investigative capability, including reconstructing events from incomplete project records and interviewing technical and project personnel. 

  • Experience managing multiple claims simultaneously across different maturity stages. 

  • Excellent professional writing and executive communication skills. 

  • Ability to operate independently and challenge unsupported assumptions while working effectively with Commercial, Project Controls, Finance, Legal, Engineering, Program Management, Operations, and subcontractors. 

  • Willingness to travel up to 25%, primarily domestic 

Preferred Experience 

Experience in one or more of the following is highly desirable: 

  • Major transportation or public infrastructure programs. 

  • Rail, transit, tolling, fare collection, or Intelligent Transportation Systems. 

  • Design-build or systems-integration programs. 

  • Testing, commissioning, and systems-acceptance disputes. 

  • Contractor-side claims involving sophisticated public-sector owners. 

  • Primavera P6 and forensic schedule analysis. 

  • Formal dispute resolution, mediation, arbitration, or expert-supported claims. 

  • P3 or project-financed infrastructure environments. 

The successful candidate should be able to step into an established governance framework, rapidly take ownership of the claims pipeline, and begin advancing defensible commercial recovery positions with limited day-to-day supervision. 

Cubic Pay Range:

$155,000- $175+ benefits.

Skills Required

  • Four-year college degree in a technical, finance, or business-related discipline
  • Ten plus (10+) years progressive experience in customer-facing contract management for complex systems integration commercial contracts
  • Demonstrated leadership in managing high dollar value fixed-price contracts for infrastructure/system solutions
  • Thorough knowledge of prime contract formation and administration, and ability to negotiate complex terms and prices
  • Thorough understanding of identification and management of flow-downs to subcontractors
  • Ability to provide workable solutions to a wide variety of contractual challenges
  • Ability to prioritize assignments and meet deadlines with minimal supervision, including working extended hours as required
  • Microsoft Office Word and Excel skills
  • Willingness to travel up to 25%
  • Experience coordinating with legal department to ensure compliance with legal and regulatory requirements
