General Purpose:

The Conflicts Counsel focuses on clearing conflicts of interest in accordance with the Rules of Professional Conduct and firm policy. Conflicts Counsel safeguards the firm's reputation and plays a critical role in supporting the Department's risk management function by ensuring that the firm and its lawyers do not inadvertently violate conflict of interest rules that govern the firm's representation of clients and that firm policies and procedures are honored, thereby protecting the firm from potential malpractice claims, motions to withdraw, return of fees, loss of reputation and the like.

Essential Duties/Responsibilities:

  1. Reviews client, related party, and adverse party data for potential new matters to determine whether these proposed engagements involve conflicts of interest and resolves any conflicts identified. This entails:
    1. identifying possible conflicts from conflict reports containing that data,
    2. contacting the attorneys responsible for relevant matters, and
    3. drafting and seeking conflict waivers or advance waivers from select clients to resolve those possible conflicts.
  2. Erects confidentiality walls pursuant to conflict waiver agreements with clients using department software, as needed.
  3. Answers conflict-related questions from firm personnel.
  4. Reviews rejected matter requests to ensure necessary documentation has been obtained and, if not, follows up with lawyers on said requests.
  5. Handles and prepares any necessary documentation for any necessary state reporting requirements per the Rules of Professional Conduct, such as the Nevada multi-jurisdictional and annual reports.
  6. Stays apprised of the various conflict of interest rules in firm jurisdictions.
  7. As needed and requested, performs research on legal issues relating to conflicts issues and assists with other assignments and projects, as assigned by the Lateral & Conflicts Counsel Supervisor. Assists and serves as an additional resource and backup to the Conflicts Researcher team with searching and preparing conflict reports, highlighting potential legal and business conflicts, utilizing applicable conflicts software, including, evaluating search results to determine search result relevancy.
  8. Works and collaborates within the Ethics & Conflict Counsel team and across the various teams in the firm's Ethics & Business Intake Department to ensure smooth operation of our systems and processes.
  9. Other tasks and projects as assigned.

Supervisory Duties (if applicable):

This position has no supervisory responsibilities.

Job Qualifications (Education, Experience and Certification):

  1. J.D. degree from ABA-accredited law school.
  2. Current admission in good standing to practice law in Colorado or another jurisdiction in which the firm practices, with no record of adverse disciplinary action.
  3. At least two years of practical legal experience.
  4. Prior experience with conflict clearance at a comparably sized law firm a plus.
  5. Knowledge of or experience with Intapp and Aderant products a plus.
  6. Excellent oral and written communication skills.
  7. Excellent time management and organizational skills.
  8. Ability to solve problems and make sound judgments, and willingness to ask for help when needed.
  9. Literacy in Word, Outlook, Excel, Adobe, Westlaw or Lexis, and Internet search engines. Ability and willingness to learn applicable software used in the conflict and intake process.

Additional Information:

  1. This is a non-partnership track position.
  2. There will be little or no direct client service.
  3. There is no billable hour expectation.
  4. Night or weekend work will be rare.

Physical Requirements:

While performing the duties of this position, the employee must have the ability to sit, stand and/or walk for extended periods of time; manipulate (lift, carry, move) weights of at least ten (10) pounds; have repetitive wrist/hand/finger movement to work on a computer and/or related office equipment; speak clearly and concisely so listeners can understand; and regularly understand the speech of another person.

Work Environment:

Professional office atmosphere. Sedentary work that primarily involves sitting or standing for prolonged periods. Position may require occasional off-hour meetings and events. Travel may also be required to firm office locations, for CLE conferences or other seminars during the business week although some overnight/weekend travel may be expected.

Schedule:

At this time, this position allows for a hybrid schedule, generally in-office 2 days per week and remote 3 days per week. Additional days in-office may be required depending on business need and the demands of specific tasks. The hybrid work structure may change at any time, including the number of in-office day requirement.

We offer a flexible work schedule within normal business hours. For appropriate coverage and support, there will be a rotating schedule among the team members that will require coverage to 6:00pm MST.
