About the Position:

As a property and casualty Claims Litigation Specialist, Coverage, you will serve as Swyfft's technical resource for coverage analysis on our Homeowner and Commercial Property and General Liability claims portfolio (both litigated and non-litigated), including habitational risks, premises liability, and bodily injury matters. You'll be expected to handle coverage matters with empathy, curiosity, and creative problem-solving to achieve timely, fair outcomes, applying working knowledge of property and casualty coverage issues, including duty to defend versus duty to indemnify.


In this position, you will review coverage on assigned claims, draft coverage correspondence (including reservation of rights letters and coverage denial letters), and communicate tender of defense and indemnification decisions to insureds, claimants, and counsel. You will also review and evaluate large or complex injury demands as they relate to coverage, and monitor defense and coverage counsel to ensure accurate, efficient handling of litigated matters assigned to their office.

*This position is a 100% remote U.S. based opportunity that can be based in one of the following states only: AL, AZ, FL, GA, KY, LA, MA, MO, NC, NJ, NY, OH, OR, PA, SC, TX, UT, VA, WA, WI.

Some travel for day-to-day work, team meetings, training, and occasional attendance at mediations, settlement conferences, or trials will be required.

Key Responsibilities: (What you'll be asked to do)

  • Ensure that all assigned coverage matters are resolved timely, reserved accurately, and handled fairly (and in compliance with state and company guidelines).
  • Review litigated complaints for proper handling and develop coverage-related legal strategies with counsel.
  • Work with multiple external/outside attorneys and provide direction related to coverage positions and legal strategy.
  • Correspond and communicate with policyholders, agents, experts, and service providers to gather information needed for coverage analysis and decisions.
  • Evaluate and apply the insurance contract as it pertains to coverage determinations.
  • Create and maintain comprehensive claim handling notation in our electronic claims management system and other related applications.
  • Review coverage on assigned claims and identify coverage positions, gaps, and issues, including duty to defend versus duty to indemnify considerations.
  • Draft coverage denial letters and reservations of rights that are clear, well-supported, and legally sound.
  • Communicate tender of defense and indemnification decisions to insureds, claimants, and defense/coverage counsel.
  • Review and evaluate large to complex injury demands as they relate to coverage and reserving decisions.
  • Monitor defense and coverage counsel on assigned matters for accurate, efficient handling, including cost containment and litigation management support.

Some Requirements:

  • 5-7 years of experience handling coverage issues on property and casualty claims.
  • 5-7 years of litigation experience in a multi-state environment.
  • Experience drafting coverage correspondence (e.g., reservation of rights letters, coverage denial letters, disclaimers) is required.
  • Working knowledge of property and casualty coverage issues, including duty to defend versus duty to indemnify.
  • Relevant experience with habitational risks, premises liability, and bodily injury matters is a plus.
  • Understand basic legal strategies in conjunction with venue particularities.
  • Experience directing or monitoring outside defense/coverage counsel on litigated matters is required.

Education:

  • Bachelor’s degree or equivalent experience is preferred.

Computer Skills:

  • We’re an MS Office environment.
  • Experience using video and chat technology (MSTeams & Slack)
  • Familiarity with claims operating systems (IMS/LSS/Symbility).

Certifications or Licensing Required:

  • You are currently licensed or eligible for licensing as an adjuster in the states of: TX, FL, CA, and NY (we can provide assistance with your licensing fees).

Other:

  • Reliable high-speed internet connectivity required.
  • Designated quiet work from home space.

Actual compensation for this position will vary based on skills, qualifications, and experience. The range reflects annual compensation (as applicable) and does not include bonuses or other incentives that the company may choose to pay at its sole discretion.
