The successful candidate will report to an Assistant General Counsel and be primarily responsible for providing counsel to Eisai’s commercial teams relating to market access, customer contracting, trade relations, government price reporting, patient support, as well as other pharmaceutical regulatory counseling.Essential Functions:
- Provides proactive and day-to-day legal support, advice and counsel on a variety of market access matters.
- Drafts and negotiates complex agreements with customers and supply chain entities (e.g., payors, group purchasing organizations, pharmacy benefit managers, wholesalers, distributors and pharmacies).
- Counsels on manufacturer-sponsored patient support programs (e.g., co-pay assistance, coupons, reimbursement support, patient assistance programs, adherence support).
- Works to ensure Eisai’s compliance with pharmaceutical laws and industry guidelines including the Anti-Kickback Statute, False Claims Act, federal and state pricing-related laws and regulations, PhRMA Code and FDA regulatory guidelines.
- Serves as the legal representative for market access materials on promotional review committees.
- Proactively informs assigned business client of important legal, enforcement and other industry developments, including DOJ and OIG Compliance Guidance and Enforcement Activities.
- Manages the legal and reputational risks of assigned business clients.
- Helps drive the implementation of legal strategy and policies.
- Develops training content as needed on legal and other risks.
Requirements:
- JD degree and 7+ years of legal practice including a minimum of 4 years focused on providing counsel to the pharmaceutical industry.
- Member in good standing of a state bar.
- Strong knowledge of FDA regulatory and fraud and abuse laws and/or pharmaceutical government price reporting laws.
- Ability to learn quickly and operate in a fast-paced, matrixed environment.
- Able to participate on key teams and be involved in key projects.
- Excellent level of oral and written communication skills, able to effectively present ideas, counsel and information to others.
Eisai Salary Transparency Language:
The base salary range for the Associate Senior Counsel, Market Access is from :189,100-248,200Under current guidelines, this position is eligible to participate in : Eisai Inc. Annual Incentive Plan & Eisai Inc. Long Term Incentive Plan.Final pay determinations will depend on various factors including but not limited to experience level, education, knowledge, and skills.
