Department Overview:

TD Legal provides industry-leading advice and counsel to all TD business segments and corporate functions. In this Senior Counsel, Insurance Litigation role, you will join a dynamic and collegial team of legal professionals who provide advice in respect of a range of litigation risks for the enterprise. The role is intended to be dynamic, with the successful candidate offering support to teams within the Legal Department and insurance business on a variety of issues. The role provides an opportunity to work in an exciting, important, and busy area, while gaining exposure to a range of stakeholders and leaders, both within TD Legal and across the enterprise.

Job Description/Accountabilities:

This is a senior role in insurance litigation, supporting TD Insurance across its business lines, principally property, casualty, and life and health insurance, with accountability in the areas of strategic and tactical legal advice, counsel, relationships and oversight, development of others, and special projects.  

  • Oversight of litigated claims involving TD Insurance, including managing active litigation, and reviewing and providing advice on matters proceeding to trial, appeal or posing significant risk to TD Insurance or its insureds.

  • Directly instructing external counsel in respect of litigation at all levels of court; note, however, that this role does not involve in-court advocacy.

  • Providing legal advice to TD Insurance on matters such as class actions, coverage issues, first-party claims, underwriting, investigations and internal processes.   

  • Performing an audit function for internal and external counsel handling claims-related litigation matters to ensure compliance with established standards and processes.

  • Identifying and proactively communicating key legal risks and mitigation strategies, while ensuring awareness among relevant stakeholders and other members of the TD Legal team.

  • Provide best in class litigation advice that is integrated with the strategies and objectives of the business, the Legal Department and consistent with enterprise-wide risk policy.

  • Provide advice to other members of the Legal Department and TD Insurance with respect to contractual interpretation, pre-litigation dispute resolution and litigation risk analysis.

  • Provide regular oral and written reporting to senior members of TD Insurance and the Litigation Department, as well as other control groups, business executives and various risk committees.

  • Provide guidance and training to business and legal partners through presentations on best practices, privilege, developments in the law, and emerging risk areas.

  • Support development and/or implementation of policies, procedures, and solutions that mitigate risk and enable the achievement of business/enterprise priorities.

  • Work closely with other control groups. Build and maintain positive working relationships by effectively communicating and regularly sharing information, learnings, and knowledge with internal and external business partners.

  • Contribute to high priority special projects and other Legal Department initiatives.

Qualifications/Skills/Experience:

  • Law degree from an accredited law school and qualified to practice law in Ontario.

  • Possess 7+ years of post-call litigation experience working within a law firm, in-house or insurance regulator, with a solid background in insurance litigation.

  • Experience litigating large, complex matters.

  • Experience providing coverage opinions or otherwise advising on complex coverage issues.

  • Advanced ability to identify problems and barriers and effectively implement solutions to further business strategy.

  • Advanced ability to operate with creativity and innovation and a desire to seek different perspectives and new ideas.

  • Demonstrated excellence in judgment, leadership, and relationship management skills.

  • Strong analytical and problem-solving skills.

  • Solid collaboration and teambuilding skills.

  • Flexibility to quickly adapt to changing and ambiguous initiatives or requirements.

  • Ability to work effectively across and throughout the enterprise, with teams and independently.

  • Ability to multi-task and operate on a day-to-day basis with limited supervision is critical.

  • Advanced ability to communicate complicated legal issues in a clear, succinct, and effective manner to business clients and other professionals, both verbally and in writing.

  • Bilingualism would be considered an asset, but not necessary.

  • Strong technology aptitude including (i) proficiency with standard office software and ability to learn and apply new technologies in work environment and (ii) capacity to understand current and emerging technologies in the industry and how they affect business objectives.
