Summary:

The Municipal Judge performs judicial activities and oversees the judicial functions of the City's Municipal Court, ensuring conformance with applicable legal requirements. The Municipal Judge is responsible for administering justice in a fair, impartial, professional, and efficient manner in accordance with applicable federal and South Carolina laws, municipal ordinances, court rules, and established judicial procedures.

Essential Job Functions:  

· Performs judicial activities and oversees the judicial functions of the City's Municipal Court, ensuring conformance with legal requirements.

· Maintains jurisdiction over cases arising under ordinances of the City and over all offenses authorized by South Carolina law.

· Completes necessary training and certifications, including attendance at any required orientations.

· Undertakes the duties of Municipal Judge in conformance with the laws of South Carolina.

· Complies with the laws applicable to the Code of Judicial Conduct and is subject to applicable Rules of Professional Conduct in the State of South Carolina as they apply to the office of Municipal Judge.

· Presides over Municipal Court proceedings and ensures matters are handled fairly, impartially, and in accordance with applicable law.

· Conducts hearings, trials, bond hearings, preliminary proceedings, and other matters within the jurisdiction of Municipal Court.

· Advises defendants of their legal and constitutional rights as required by law.

· Hears testimony, evaluates evidence, rules on motions, and renders decisions in matters before the Court.

· Determines appropriate fines, sentences, and other dispositions within the authority granted by law.

· Issues warrants, summonses, subpoenas, orders, and other judicial documents as authorized by law.

· Reviews and signs court-related documents and performs other judicial duties and responsibilities as authorized or required by applicable law.

Requirements

Minimum Qualifications:  

· Must possess the knowledge, judgment, integrity, professionalism, and judicial temperament necessary to perform the responsibilities of Municipal Judge.

· Must successfully complete and maintain all training, certification, recertification, orientation, and continuing education requirements applicable to South Carolina Municipal Judges.

· Must possess the ability to understand, interpret, and apply applicable South Carolina laws, municipal ordinances, court rules, policies, and judicial procedures.

· Must demonstrate the ability to remain fair, impartial, objective, and independent in judicial proceedings.

Must possess strong oral and written communication skills and the ability to interact professionally with defendants, attorneys, law enforcement personnel, witnesses, victims, court staff, and members of the public.  

· Must maintain confidentiality and comply with applicable standards of judicial ethics and conduct.

· Must be available to preside over scheduled court sessions and perform other judicial responsibilities as required.

· Must satisfy all eligibility requirements established by South Carolina law and the South Carolina Supreme Court.

Preferred Qualifications:  

· Previous judicial, legal, municipal court, prosecutorial, defense, or other relevant legal experience.

· Knowledge of South Carolina criminal law, municipal ordinances, court procedures, and rules of evidence.

· Prior experience working with municipal government or the South Carolina court system.

· Strong decision-making and analytical abilities.

· Ability to communicate clearly, professionally, and respectfully.

· Ability to manage difficult or sensitive courtroom situations.

· Ability to evaluate information and evidence objectively.

· Professional demeanor and appropriate judicial temperament.

Appointment:  

The Municipal Judge is appointed by City Council in accordance with applicable South Carolina law and serves under the terms established by the City and applicable state law. The selected candidate will be required to take the prescribed oath of office and satisfy all applicable certification and training requirements before and during service as Municipal Judge.
