The VP, Legal, Bright HealthCare role will be the chief legal counsel to the Bright HealthCare business, which includes currently IFP,  Medicare Advantage and Commercial lines of business.  The role will oversee a talented team of lawyers, compliance, regulatory affairs, and support professionals. The VP, Legal will be a strategic partner to the Bright HealthCare CEO and Executive Team. In addition to day-to-day counsel support to the health plan business leadership, this role will manage and provide support on a variety of activities, including regulated insurance company capital management, delegate/FDR contracting, bid and insurance certificate/policy support, health plan license maintenance, insurance holding company transactions and associated filings, sales and marketing review, and reinsurance contracting. 

ROLE RESPONSIBILITIES

  1. Manage the day-to-day legal matters of Bright Health Group’s health plan business, including advising on legal and regulatory matters and developing, advising on, and supporting the implementation of corporate risk mitigation strategies.
  2. Manage the Bright HealthCare Regulatory Affairs team and assist strategically with escalated matters of importance before state and federal regulatory agencies. Develop and maintain strong and trusted relationships with senior regulatory leadership representing the various regulatory agencies with whom Bright HealthCare interacts.
  3. Advise on Bright HealthCare compliance program strategy, including escalated compliance matters that present legal or regulatory risk to the company.
  4. Provide legal, legislative, and regulatory guidance to the Bright HealthCare executive team to assist with the business strategy.
  5. Immediately and independently step into an advisory role with senior leadership.
  6. Assist Bright Health’s Corporate Development team with mergers and acquisition opportunities, primarily with respect to due diligence and obtaining necessary regulatory approvals and post-transaction integration activities of legal and regulatory functions.
  7. Maintain subject matter expertise regarding applicable state and federal law and regulations applicable to Bright HealthCare’s businesses – Medicare Advantage, Medicare Special Needs products, and on- and off-exchange individual market products.
  8. Interface with legal department counterparts in other Bright Health Group business units to address enterprise-wide legal issues.
  9. Assess and mitigate business risks with a legal and regulatory impact.
  10. Work with other Bright HealthCare business areas regarding significant matters that cut across organization.
  11. Keep abreast of legislative and regulatory changes.
  12. Draft and negotiate contracts, including certain provider, vendor, and health plan services delegation agreements that minimize risk and maximize business goals.

EDUCATION, TRAINING, AND PROFESSIONAL EXPERIENCE

  • Bachelor’s degree and Juris Doctor required.
  • 10+ years of experience practicing law, with experience as senior health plan legal counsel for most of that time.
  • Significant experience managing high functioning teams.
  • Thorough understanding of the Patient Protection and Affordable Care Act and corresponding regulatory requirements and statutory and regulatory framework governing Medicare Advantage and Medicare Part D plans.
  • Strong understanding of and experience negotiating value-based arrangements between payers and providers.
  • Strong proficiency with health plan industry practices and trends, especially during the era of the ACA.
  • Strong expertise in state and federal regulatory frameworks governing Medicare Advantage, Medicare Special Needs products, and on- and off-exchange individual market products.

LICENSURES AND CERTIFICATIONS

  •  Active, unrestricted license to practice law in at least one jurisdiction.

WORK ENVIRONMENT

It is expected that this position will be performed in an office setting in Minneapolis, Minnesota. Subject to company policy and management approval, the VP, Legal, Bright HealthCare position may be performed remotely in the near-term future as a result of safety concerns related to COVID-19. Some travel may be required, contingent upon company policies related to management of COVID-19 risks.
