Responsibilities
- Review assigned requirements from division order title opinions, determine what each one requires, and identify the resolution path.
- Locate the mineral owners, royalty owners, heirs, devisees, and successor entities named in each requirement using county records, probate and district court filings, obituaries, and public search resources.
- Contact owners by telephone, mail, and email, explain the requirement and the instrument you're asking them to sign in plain language without giving legal advice, and manage the execution logistics including notary coordination and return mailings.
- Draft the curative instruments, including stipulations of interest, stipulations of interest and cross-conveyance, disclaimers, affidavits of heirship, corrective assignments, quitclaim deeds, and ratifications, with accurate legal descriptions, decimal interests, exhibits, and signature blocks matched to the capacity in which each party signs.
- File and record executed instruments with the county clerk and track each one through recording.
- Maintain organized records of every contact, response, and mailing in the curative contact log, and communicate status, obstacles, and items that need escalation to the supervising landman.
Required Qualifications
- Prior experience handling title curative work.
- Ability to read a division order title opinion, understand what each requirement is asking for, and recognize where the defect sits in the chain of title.
- Working knowledge of common title defects and how they're cured in practice, including probates, affidavits, powers of attorney, and corrective instruments.
- Comfort communicating with mineral and royalty owners outside the industry by telephone and in writing. Many of the owners you'll contact are elderly, recently bereaved, cautious about unsolicited calls, or unaware they own an interest at all.
- Careful drafting from confirmed facts only. Every recital in a curative instrument has to trace to a recorded document, the title opinion, or information the owner has verified, and the discipline to stop and ask rather than fill a gap with an assumption is part of the job.
- Independent judgment, the ability to prioritize and track a list of open requirements sitting at different stages, and proficiency in Google Workspace.
