Director - Enterprise Products & Platforms Business Counsel
As a member of Capital One’s Enterprise Products & Platforms Business Counsel team you’ll apply strategic and analytical skills to Capital One’s newest and most innovative digital initiatives. You’ll dive in to understand the technology and services that Capital One’s Enterprise Products & Platforms teams deliver to our various lines of business, and apply complex financial regulations to help manage legal risk. You’ll be a key player on the legal team supporting innovation across Capital One, including digital wallets and emerging payment technologies like Virtual Card Numbers, identity management and fraud prevention, data management in a complex cloud environment, customer platforms like our website and mobile app, and our sharing and collection of data to support open banking. And you’ll do it all in a collaborative, supportive environment that values your insight, promotes continuous learning, and rewards creative thinking.
To succeed in this role, you’ll need strong legal and business skills. Written and oral communication and organizational skills are key, as is the ability to focus on what really matters to drive business initiatives forward while clearly defining legal risk. You should have a successful track record of thriving in a fast paced, entrepreneurial and dynamic environment.
In this role, you’ll be part of a team that:
Provides strategic advice: You’ll be something of an investigator: you’ll work on projects that unite our many lines of business (Branded & Partnerships Cards, Retail Bank, Commercial Bank, Auto Finance, and other Enterprise products like Capital One Shopping), so you’ll drill down into how we do what we do, and why we do what we do, so we can build a better way. You’ll understand the business’ objectives, understand the full landscape and context of the applicable law, and work through unchartered territory as you apply the law to business initiatives.
Translates the law for the business, and translates business intent for the lawyers: You’ll need to understand the law (e.g., the alphabet soup of consumer finance laws including TILA & Reg Z, EFTA & Reg E, GLBA & Reg P, FCRA & Reg V, TCPA, E-SIGN, CCPA/CPRA, etc.), understand the business (e.g., consumer credit, customer identity management, fraud prevention, consumer budgeting and finance), understand the technology (APIs, mobile and web apps, SaaS, AI, machine learning), and put them all together as a trusted business advisor. You’ll translate between business intent, regulatory requirements, legal guardrails, best practices, etc. You won’t need to know everything about everything, but you’ll need to know a little about a lot, and know how to communicate legal requirements to the business, and business requirements to legal subject matter experts.
Partners to Foster Innovation: You’ll collaborate closely with colleagues across the Legal Department to fully evaluate and scale risk. You’ll work to push responsible innovation in challenging gray areas.
Here are some examples of tasks you would be responsible for:
Reviewing product feature changes for regulatory compliance issues by meeting with business partners to better under the feature, identifying legal obligations or risks, and providing recommendations to manage legal risk, e.g., revising user-facing content, drafting product terms and disclosures, and assisting with strategic partnership integrations and contracts,
Performing legal research on the application of existing and new laws to novel implementations of technology (e.g., privacy laws, TCPA, IP, Reg Z, Reg E, FCRA; APIs, cloud platforms, mobile apps, SaaS, machine learning and artificial intelligence), summarizing findings in easily digestible formats for use by business partners, developing legal theories when applying the law to complex use cases, and achieving consensus among the legal subject matter experts and business partners
Supporting regulatory advocacy initiatives affecting the Enterprise Products and Platforms that we support
Helping the team draft, organize, and maintain key artifacts, like terms and conditions, and past legal advice
Managing business and legal meetings, e.g., draft and manage meeting notes and outcomes, manage advice intake request forms and attendees
Managing and developing team projects and processes
Basic Qualifications:
Juris Doctor from an accredited law school
Active member in good standing of at least one state bar
At least 6 years experience researching and applying applicable law in-house or at a law firm
Preferred Qualifications:
Personal interest in technology
2+ years of experience in the technology and banking industries, either in-house or at a law firm
7+ years experience in the legal field
Experience with consumer finance laws and regulations
Excellent written and oral communication
Excellent project and process management skills
Attention to detail
Ability to understand and communicate about technology, financial, and legal concepts
Ability to manage multiple assignments and work in a fast paced environment
Self-starter
Persistence in closing out tasks and projects
Desire to Change Banking for Good
