The Amherst Residential platform provides a comprehensive suite of services to facilitate the ownership of single-family rental properties, including property management services, asset-level financing, and asset management services. With a deep understanding of and proprietary analytics on the single-family home and mortgage markets, Amherst's platform combines a unique combination of national scale with local market knowledge and execution.

The Legal & Compliance team seeks a Corporate Counsel who will report directly to the Senior Counsel & Chief Compliance Officer, who leads legal and compliance teams for Real Estate Operations. The Amherst Homes division partners with developers to construct single-family rental communities in a build-to-rent strategy. This role will help manage the legal and compliance needs for these communities, including HOA formation and management. 

Duties/Responsibilities:

  • Draft and negotiate HOA formation documents and CCRs relating to the various single-family rental communities;

  • Coordinate and oversee the legal aspects of transitioning existing HOA control and management from developer when appropriate; community change and amendment; and governance;

  • Analysis of existing deed and use restrictions;

  • Manage HOA related litigation and appeals; advise and assist the team that manages HOA violations and lien;

  • Manage local, outside counsel engaged to assist the Company with related HOA matters;

  • Advise team leaders on complex legal matters related to the Company's compliance with real property, HOA, community management and other relevant laws; key legal risk areas pertaining to such matters; and general legal matters as appropriate.

Qualifications:

  • JD required; bar membership required; licensed to practice in a state in which Amherst operates; this position is based in the Company’s Austin, Texas headquarters

  • 5 – 7 years in real estate with a preferred focus in single family or multi family transactions; HOA, POA and Condominium Association formation and management.

  • Strong project management skills, ability to run transactions to completion, work independently, exercise good judgment, and change direction or priorities on short notice.

  • Attention to detail is critical; professionalism and customer-centricity are a must.

  • Intelligent, energetic and goal-oriented with the ability to juggle multiple tasks, while exercising sound judgment.

  • A self-starter with the ability to follow through and complete tasks in a highly intellectual, collaborative environment.

  • Well-organized and detail oriented.

  • Excellent oral and written communication skills.

  • High competencies in strategic thinking and negotiation

  • Reports to Senior Counsel & Chief Compliance Officer – Real Estate Operations
